These Terms of Service (“Terms”) govern your access to and use of the ArticleIQ platform (the “Service”), which is operated by Gautham Consulting LLC, DBA “Cumulative Data” (“Company,” “we,” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
1.1 Service Overview
ArticleIQ is a platform that uses AI technology to process publicly available news articles and provide summarizations (“Summaries”). It is currently offered free of charge, supported by advertising, and subject to usage limits (see Section 2.2).
1.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in such courts.
2.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
2.2 Usage Limits
We provide free access to the Service, supported by ads. However, we currently enforce a usage limit of up to 10 site/page requests per day and 100 new summarizations per day per user. We reserve the right to modify these limits at any time without notice.
2.3 Prohibited Activities
You agree not to:
- Use the Service for any unlawful or fraudulent purpose.
- Attempt to reverse-engineer, disassemble, or otherwise tamper with the Service or any related software.
- Bypass or attempt to bypass any security measures or usage limits implemented by the Company.
- Submit any material that you do not have the right to process or share.
- Modify the content of any article solely to manipulate or affect its summarization.
Since the Service currently only processes publicly available articles, there is no opportunity to upload private user content (other than optional feedback to developers). You remain responsible for ensuring that any feedback you provide is lawful. All feedback is owned by the company.
3.1 Ownership of Summaries
All Summaries generated by the Service are owned by the Company. The Service may include a “Share” option that allows you to share a link to the Summaries. By sharing such links, you acknowledge and agree that you do not acquire any ownership rights to the Summaries.
3.2 License to Use
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial use. You may share or distribute links to the Summaries as provided within the Service.
3.3 Trademarks & Branding
All trademarks, logos, service marks, and other proprietary identifiers displayed on or through the Service are the exclusive property of the Company or its licensors. You may not use them without prior written permission.
4.1 Privacy Notice
For information on how we collect, use, and share your personal data, please review our Privacy Notice, which is hereby incorporated by reference. By using the Service, you agree to the practices described in the Privacy Notice.
4.2 DOM & Public Articles
We capture the DOM (Document Object Model) of publicly accessible websites solely for the purpose of generating Summaries. We do not store any user-generated content, except for optional feedback you may choose to provide. Please see our Privacy Notice for data retention and third-party sharing details.
5.1 Disclaimer of Warranties
You expressly understand and agree that:
- The Service, including all AI-generated Summaries, is provided on an “as is” and “as available” basis, without warranties or conditions of any kind, either express or implied.
- We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- While we strive for accuracy in our AI-generated Summaries, we do not guarantee their accuracy, completeness, or reliability. The Summaries may contain errors, omissions, biases, or outdated information.
5.2 Limitation of Liability
To the fullest extent permitted by applicable law:
- In no event shall the Company, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
- Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you to the Company for the use of the Service (if any) in the 6 months preceding the event giving rise to the claim.
5.3 Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or in any way connected with your breach of these Terms or your misuse of the Service, including but not limited to any sharing of Summaries in a manner not expressly permitted by these Terms.
6.1 Termination by Company
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and without prior notice to you.
6.2 Effect of Termination
Upon termination, the licenses and rights granted to you under these Terms will immediately cease. Any provisions of these Terms that, by their nature, should survive termination (including but not limited to indemnification and limitation of liability clauses) will remain in effect.
7.1 Updates to Terms
We may modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page.
7.2 Acceptance of Updated Terms
The web and/or plugin UI will require you to accept the updated Terms before continuing to access or use the Service. If you do not agree to the updated Terms, you must cease using the Service.
8.1 Entire Agreement
These Terms, together with our Privacy Notice and any additional policies referenced herein, constitute the entire agreement between you and the Company regarding your use of the Service.
8.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
8.3 No Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
